These terms govern your use of the RiskMind website and platform. The most important point: analysis from the Service and from ARIA is insight to inform a decision. Coverage is real only when a carrier binds it in writing.
Last updated · May 2026These Terms of Service ("Terms") govern your access to and use of the RiskMind Insurance LLC ("RiskMind") website and platform (together, the "Service"). By using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company.
RiskMind is a licensed commercial insurance brokerage. The Service provides risk analysis, document organization, carrier marketing, and policy-servicing tools, and connects you with licensed Risk Strategists who place and service commercial insurance coverage.
RiskMind is a brokerage, not an insurance carrier. We do not issue policies or underwrite risk. Coverage is issued by insurance carriers, subject to their underwriting and their policy terms.
Risk snapshots, scores, gap flags, benchmarks, and other output produced by the Service or by ARIA are analytical insights intended to inform a conversation with a licensed advisor. They are not legal advice, not tax advice, and not a coverage recommendation.
Indicative pricing ranges are estimates. They are not quotes and are not bindable. A bindable quote requires carrier underwriting, and coverage is effective only when bound in writing by an authorized carrier or its agent. Always rely on the actual policy documents issued by the carrier for the terms of any coverage.
The Service is intended for businesses and the people who manage their insurance. You must provide accurate information when you create an account, keep your credentials confidential, and promptly notify us of any unauthorized use. You are responsible for activity under your account and for the team members you invite.
You agree to use the Service lawfully and only for its intended purpose.
You retain ownership of the documents and information you submit. You grant RiskMind the rights necessary to host, process, and use that content to provide the Service. Including marketing your account to carriers and producing the analysis you have requested. Our handling of your content is described in the Privacy Policy.
The Service, including its software, design, content, and the ARIA system, is owned by RiskMind and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership in it.
The Service relies on third parties, including insurance carriers, the Smart Choice Insurance network, and infrastructure and AI providers. RiskMind is not responsible for the independent acts, policies, or coverage decisions of insurance carriers. Carrier coverage is governed solely by the policy the carrier issues.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, RiskMind disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that analytical output will be free of inaccuracy. This section does not limit the duties RiskMind owes you as a licensed insurance producer under applicable insurance law.
To the fullest extent permitted by law, RiskMind will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including obligations arising from RiskMind's licensed brokerage activities.
You agree to indemnify and hold RiskMind harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of a third party.
You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated or if required to protect the Service or comply with law. On termination, clients may request export of their account data, and provisions that by their nature should survive. Including intellectual property, disclaimers, and limitation of liability. Will survive.
These Terms are governed by the laws of the state in which RiskMind Insurance LLC is organized, without regard to conflict-of-laws rules, and subject to any non-waivable rights under the insurance laws of your state. We may update these Terms as the Service evolves; the "last updated" date above reflects the current version, and continued use after a change constitutes acceptance.
